Cross Compliance: Applying for a derogation from hedge or tree cutting/trimming ban for August 2016

Information released on CAAV website 27th May 2016:

Where a farmer will be sowing either oilseed rape or temporary grassland during August 2016, it is possible to apply to the RPA to request a derogation from the cross compliance hedge or tree cutting/trimming ban that is usually applicable up to 31st August 2016. To apply for a derogation, email the RPA at ruralpayments@defra.gsi.gov.uk or write to RPA, PO Box 352, Workshop, S80 9FG. The heading should be ‘Cross compliance derogation’, explain that it is intended that oilseed rape or temporary grassland be sown in August 2016 and include the following information:-

  • SBI and business name;
  • either the land parcel reference numbers where the hedges or trees are located which are to be cut/trimmed or a map showing the sections of hedge or trees that are to be cut/trimmed; and
  • any other supporting evidence, for example, photographs or diagrams

Derogation requests should be submitted as soon as possible to allow the RPA to issue confirmation in writing. The cutting or trimming work cannot start until that written confirmation from the RPA has been received.
